Christmas Contact Arrangements

For separated families with children, it can be difficult for parents to reach agreement in respect of contact arrangements over the festive period. Christmas contact is an extremely sensitive and emotive subject as both parents would of course like to spend this special time with their child/children.

However, it is inevitable that parents will need to accept that this time will have to be shared, with the child/ren spending Christmas morning and perhaps even the entire day with one parent. There are however, several arrangements that can be made to ensure that your child spends quality time with both families. Consideration could be given to the child spending Christmas Eve and Christmas Day with the one parent, with the other collecting them on Christmas Day evening or even Boxing Day morning and there being somewhat of a second Christmas Day celebrated during that time. This can then be alternated on an annual basis so that each parent has the opportunity of spending time with their child/children on Christmas Day itself.

If you have not already done so yet, you should contact your ex partner with a view of agreeing Christmas arrangements now – if you are unable to reach an agreement, then we can provide you with legal advice with a view to a letter being sent to your ex partner in an attempt to resolve matters as early as possible so that everyone can plan their festive season.

It should also be remembered that at present, the current COVID19 restrictions should not preclude children having meaningful contact with both parents, unless it is unsafe to do so. In line with the Welsh Government’s guidance, children are permitted to travel between homes in order to spend time with both parents. Why everyone should consider making a Lasting Power of Attorney

We all know that we should write a will, but too few of us know we should also consider making a Lasting Power of Attorney.

A Lasting Power of Attorney (LPA) gives another individual(s) the legal authority to look after specific aspects of someone’s financial affairs and/or health and welfare should they lose the capacity to do so. They are not just for the elderly; younger people may become incapacitated through accident or illness and we have clients of all ages who have planned for the future by preparing an LPA.

If someone becomes incapacitated and they were the person who always dealt with the family’s finances, then without a LPA in place, relatives may face long delays and expense in applying to the Court of Protection to get access to bank accounts, insurance companies and utility and mobile phone companies.

It is important to ensure that an LPA is drafted correctly – otherwise life can be made unintentionally difficult for your attorneys in the future. All our LPA work is undertaken by qualified Solicitors and we offer competitive fixed fees for preparing LPAs.

Office Working

As we move further into the ‘Firebreak’ imposed by the Welsh Assembly Government, we want to reassure everybody that it is very much ‘business as usual’ at Ungoed-Thomas & King – as much as it possibly can be in these strange times.

We have for the last two months split our team into two shifts – one in the morning and another in the afternoon – the purpose being that if a member of staff tests positive for COVID19 in one team, the other team is still able to come into the office and deal with matters ongoing.

During this Firebreak period, we are trying to deal with clients and third parties via the telephone and e-mail wherever possible. However, where there is a need for clients to visit the office this is done on an appointment only basis and clients are asked not to attend the appointment if they are unwell. Government social distancing measures are followed and the appointment rooms are cleaned thoroughly after each appointment.

We thank everyone for their continued support over these last few months and as we move forward and hope that everyone continues to stay safe.

Changes to Land Transaction Tax

The Welsh Government has today announced changes to the Land Transaction Tax thresholds for people buying their main home in Wales.

The starting threshold for Land Transaction Tax will increase from £180,000 to £250,000 for the residential main rates when this new measure is introduced on Monday 27th July 2020.  This tax reduction will last until 31st March 2021.

The new threshold will further reduce the tax burden in Wales , and it is estimated that around 80% of homebuyers liable to the main rates of Land Transaction Tax, will not pay any tax. These changes reflect the nature of the housing market in Wales, where house prices on average are considerably lower in Wales – £162,000 – than in England where the figure is £248,000. For first time buyers, the average purchase price paid is £139,000 in Wales and £208,000 in England.

This tax reduction will not apply to purchases of additional properties including buy to let and second homes.

Coronavirus -COVID 19

 Following on from the Prime Minister’s announcement last night, we intend to run a skeleton service within the office to ensure that we can deal with urgent Will requests, comply with Court Dates and Property Completions. We will ensure that any staff who do come into the office will practice safe Social Distance measures.

Other staff will be working from home to ensure that we keep matters progressing as best we can. As the safety of our staff and clients is paramount, we would ask that clients do not attend our office premises but instead e-mail us on mail@utk.co.uk or you can telephone us and we have diversions in place to ensure that calls are answered.

Conveyancing Quality Scheme

We have just received notification that our reaccreditation application in respect of the Law Society’s Conveyancing Quality Scheme (CQS) – the mark of excellence for the home buying process – has been successful for another 12 months.

The re-accreditation process is a way of assuring residential home buyers and sellers and banks and insurers, that we have the skill and expertise to provide quality residential conveyancing advice.

We are proud to still be the only Law Practice in Carmarthenshire to have achieved CQS, WIQS – which is a mark of excellence in dealing with Wills and Probate matters and Lexcel – the Law Society’s Practice Management standard.

Bank prepared Wills

Recent press articles have highlighted the exorbitant costs that some Banks have been charging families when dealing with the Estates of their loved ones.

Banks offered a low cost will-writing service as an incentive for taking out insurance or fee charging current accounts, going back to the late 1990s and early 2000s. It is estimated that 1.5 million wills have been written by Banks in the last twenty years

In these wills, the small print gave the Banks the right to appoint themselves as Executors and they then charge a percentage on the value of an Estate when they administer it. When the Banks’ customers signed up for these wills, they did not realise what exactly this percentage charge would mean and with house prices having risen in this period, it is now obvious that these fees are excessive.

A recent case in the Daily Mail highlighted an Estate worth £400,000 that Nat West was proposing to charge £11,500, yet when the Executor had spoken to a legal practice, he had been advised that their charges would be in the region of £4,000 for dealing with the same Estate.

At Ungoed-Thomas and King, we can do as much or as little of the Estate Administration work as the Executors wish and will always give an estimate at the start of a matter as to how much it is likely to cost and will advise you beforehand if we are likely to exceed that estimate.  The cost will be based on the amount of time taken to carry out the necessary work, not on the value of the assets.

We are also accredited members of the Law Society’s Wills and Inheritance Quality Scheme and are the only legal practice in Carmarthen to have attained this standard.
