Do you need a Deputyship Order?

Are you responsible for someone who lacks the mental capacity to manage their financial affairs? If so, if they have not made either an Enduring or Lasting Power of Attorney appointing you in an official capacity, you will need to make an application to the Court of Protection to be appointed as their Deputy.
A Deputyship Order is an Order from the Court of Protection authorising someone to manage the Financial Affairs of the person who lacks mental capacity. In certain circumstances, the Court can also make Deputyship Orders relating to Health and Welfare matters.
A common scenario triggering the need for a Deputyship Order, is where a parent has been discharged from hospital and a Nursing Home needs to be found for that individual. This will necessitate the signing of a contract with a Nursing Home and payment of the Care Home fees. It is not possible to have access to an individual’s finances, nor contract on their behalf without legal authority either in the form of an Enduring or Lasting Power of Attorney, or a Deputyship Order.
We recommend that everyone makes a Lasting Power of Attorney, so that in the event of mental incapacity, important decisions can be made by someone you know and trust. Trip of a Lifetime?

We are of course referring to your holidays and not a mishap. However with the summer holiday period fast approaching, if you do suffer an injury abroad here are a few things worth knowing:

– remember to pack your European Health Insurance Card (EHIC card) if you are travelling to the EU or EEA. However you should also take out travel insurance for the additional costs (over and above medical treatment) that you may incur.
– you should check whether you are travelling on a packaged holiday (i.e. if you booked the flight and accommodation through the same company). If not, different laws will apply and you will probably have to commence proceedings where the accident happened (travel insurance is essential in such cases).
– if it was a packaged holiday, then your rights are the same whether injured at your holiday accommodation or on a daily excursion. You will be entitled to sue in England and Wales, but you will have to establish that the accident was not your fault – as you would with a personal injury sustained at home.
– report the accident to your holiday rep or the hotel/accommodation and get medical assistance abroad and advise your insurers of your plight as soon as possible so that they can advise and guide you so that you do not prejudice your policy. Do not wait until you come home.
– take as much information home with you as you can such as photographs of the scene, names and addresses of witnesses and relevant medical records
– keep and a note of all expenses incurred as they do add up so that it will make it easier to pursue a claim, if you decide to do so, upon your return.

Sometimes, particularly if you have inherited assets from someone else, you may find that they are held through a trust – in other words a legal entity under which one or more persons known as the trustees) hold the assets (the trust fund) on behalf of others (the beneficiaries).

These trusts can rumble on for a number of years and the original intention of the person who set up the trust may have passed e.g. the trust may have been intended for educational purposes or to provide a form of protection over the assets for the benefit of the beneficiary but this need may now have passed. The St Clears YFC Agricultural Show is being held on the 21st May 2016 at the United Counties Show ground at Nantyci.

The Cothi Bridge Agricultural Show takes place on Saturday 28th May 2016 at the Showground in Pontargothi .

We will have a stand at both shows as usual and hope that friends old and new will pop along and join us for some refreshments.

The Remarriage Trap

More and more people are choosing to issue their own divorce petitions or are instructing online divorce companies at a budget price.

Caution must be exercised when doing so as there can be serious consequences if forms are not completed correctly and the individual isn’t fully advised. This is particularly the case if parties choose to simply deal with dissolving the marriage and are not reaching a financial settlement.

As it stands, the Matrimonial Causes Act 1973 (MCA 1973) is the legislation that sets out the rights of spouses upon divorce. One of the subtleties outlined within the Act is what is known as the ‘remarriage trap’. Read more →
